Cyanweb Solutions Pty Ltd Standard Limited Warranty.
Cyanweb Solutions Pty Ltd. warrants all New Cyanweb Personal Computer Products to be free from defects in materials or workmanship under normal use during the warranty period as noted on the original sales invoice. The warranty period commences on the date of invoice. The warranty extends only to you, the original Purchaser, and is not transferable. This Limited Warranty is valid only within Australia.
Limited Warranty Period Exceptions
• Portable computer batteries, including but not limited to batteries purchased with and used to power Notebooks, Tablet PCs and PDAs, are covered by a 1 Year Limited Warranty.
• All peripheral devices and individual component purchases are covered by the original manufacturer’s limited warranty.
If a defect exists, at its option Cyanweb Solutions Pty Ltd. will (1) Repair the Computer Product at no charge, using new or refurbished replacement parts, or (2) Exchange the Computer Product with a Computer Product that is new or which has been manufactured from new or serviceable used parts and is at least functionally equivalent to the original Computer Product.
Repair or Exchange will be made at no additional charge to the customer. Following Repair or Exchange, the resulting Computer Product will retain only the balance of the original warranty period that commenced from the date of invoice of the original Computer Product.
Before you deliver your Computer Product for Limited Warranty service or, if applicable, make it available to a technician during on-site service, it is your responsibility to keep a separate backup copy of the system software, application software and data, and to disable any security passwords unless otherwise arranged. You will be responsible for reinstalling all such software, data and passwords unless otherwise arranged. Data recovery is not included under this Limited Warranty, and Cyanweb Solutions Pty Ltd. is not responsible for data that may be lost or damaged during transit or repair.
On-Site Warranty Program
Eligible customers will receive appropriate Limited Warranty service through the Cyanweb Solutions Pty Ltd On-site Warranty Program. Limited Warranty services under this Program shall only be performed during normal business hours, Monday through Friday, 8:00 a.m. to 4:30 p.m. WST.
Obtaining Warranty Service
To obtain warranty service for Cyanweb Personal Computer Products, you must first call Cyanweb Solutions Pty Ltd. at 0431 757 449. The telephone representative will provide further information, including delivery instructions, if appropriate.
Warranty Programs and Technical Service do not include:
Repair and/or replacement of Computer Products or Components damaged by shipment, misuse, accident, modification or attempted repairs by anyone other than Cyanweb Solutions Pty Ltd., unsuitable physical or operating environments, power surges, improper maintenance, software related failures including Operating Systems, viruses, trojans or other malware, intentional misuse of products, tampering or removal of Cyanweb Solutions Pty Ltd. serial numbers, failures caused by a product for which Cyanweb Solutions Pty Ltd. is not responsible, intentional misuse of equipment by the customer, modification of original system parameters including BIOS modifications, system settings, Overclocking of any component as well as acts of God including but not limited to floods, lightning, earthquakes, hurricanes, and tornadoes.
THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. Cyanweb Solutions Pty Ltd. SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF Cyanweb Solutions Pty Ltd. CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THIS LIMITATION MAY NOT APPLY TO YOU. Cyanweb Solutions Pty Ltd.’S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE AND ACCESSORIES IS LIMITED TO REPAIR OR REPLACEMENT AS SET FORTH ABOVE. THESE WARRANTIES GIVE YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA STORED IN OR USED WITH Cyanweb Solutions Pty Ltd. PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT. Cyanweb Solutions Pty Ltd. SPECIFICALLY DOES NOT REPRESENT THAT IT WILL BE ABLE TO REPAIR ANY PRODUCT UNDER THIS WARRANTY OR MAKE A PRODUCT EXCHANGE WITHOUT RISK TO OR LOSS OF PROGRAMS OR DATA. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
